Terms and conditions for using Shawir legal consultation app

This agreement is concluded between “Shawir App” and the “Beneficiary/User” of the services provided through Shawir.
Article 1: Definitions
- Shawir: An application owned by Estshr for Information Technology (Commercial Registration No. 1010848899).
- Agreement: The service terms and conditions including the Privacy Policy.
- App: The “Shawir” application.
- Service Provider: A natural person (legal consultant) representing a legal entity — Estshr for Information Technology — who provides legal consultations through the app.
- Beneficiary/User: A natural or legal person who has an account in the app and wishes to obtain legal consultation services in personal status matters via the app.
- Data: All information related to the Beneficiary, including personal data and uploaded files.
- Account: The Beneficiary’s account created to obtain Shawir’s services.
- Service: The legal consultation provided through the app.
Article 2: Terms of Use
- The Beneficiary must be at least eighteen (18) Hijri years of age.
- The Beneficiary must have the legal capacity to accept the terms and conditions in this Agreement and the Privacy Policy.
- The Beneficiary is obligated to provide accurate and correct information when registering or requesting the service.
- It is prohibited to use an account by anyone other than its owner or to impersonate the account owner.
- It is prohibited to send, attach, transfer, or store any materials or files protected under intellectual property laws or other laws, or any materials that breach contractual obligations.
- For verification, delivery control, and quality assurance, the app may record calls/sessions when needed.
- It is prohibited to engage in any action that may affect the app’s security, including:
- Uploading, downloading, transferring, entering, or sending any materials, files, information, or data — in any form — that are contaminated (e.g., contain viruses, spyware, or untrusted content).
- Attempting to hack the app or affect the provided service in any manner.
- Attempting to change, destroy, or tamper with the app.
- The Beneficiary bears any damages resulting from their actions or omissions that relate to app protection or to the provided service.
Article 3: Privacy Policy
- The Beneficiary’s privacy and data protection are priorities for Shawir. You can view the Privacy Policy through the app.
Article 4: Service Scope
- Shawir provides legal consultations in personal status matters (procedural and substantive).
Article 5: Intellectual Property
- Content: The service provided by Shawir and all information and data appearing therein are owned by Estshr for Information Technology. No ownership rights are assigned or transferred to the user.
- Trademark: The Shawir trademark is owned by Estshr for Information Technology.
- The Beneficiary may not transfer, display, produce, distribute, publish, or exploit the provided information and data without written permission from Estshr for Information Technology.
- Any ideas or suggestions submitted to improve the service or develop the app become the property of Estshr for Information Technology upon submission.
Article 6: Service Request Provisions
- Calls/sessions are automatically assigned to an available consultant in the app; the Beneficiary may not select a specific consultant.
- The basic service duration is fifteen (15) minutes. The Beneficiary may request an extension for an additional fee.
- The Service Provider (Shawir) may end the call/session after fifteen (15) minutes unless the Beneficiary extends or requests an extension.
Article 7: Service Fees
- The Beneficiary bears the specified service fees, which are determined based on the time granted by the Service Provider.
- Service fees are collected in advance before delivery.
- Fees are non‑refundable after the Service Provider accepts and delivers the service, except in specific cases determined by Shawir, such as dissatisfaction with the provided service quality. A refund request must be submitted within 48 hours from the end of the service.
- Refund requests are reviewed by the app. If approved, the amount is refunded via bank account or the used payment card according to banking procedures and may take up to 14 business days.
- Shawir reserves the right to refuse a refund request if unjustified or contrary to the service terms.
Article 8: Payment Policy
- The basic consultation value is one hundred and fifty (150) SAR for fifteen (15) minutes.
- The Beneficiary may request an additional fifteen (15) minutes for an extra fee of seventy‑five (75) SAR.
- All prices include VAT.

- Credit Card

Article 9: Modification of Terms
- Shawir may modify these terms at its sole discretion.
- The Beneficiary will be notified at least five (5) days before the modified terms take effect via their account in the app; the Beneficiary may accept or reject them.
- Amending these Terms does not necessarily mean the Privacy Policy is amended, and vice versa.
Article 10: Complaints
- The Beneficiary may file a complaint against the consultant within a maximum of three (3) days from service delivery.
- The Beneficiary may file a complaint regarding any malfunction in the legal services or app issues.
- Complaints can be submitted via email: info@shawir.sa.
Article 11: Governing Law and Jurisdiction
- Any dispute arising from this Agreement or the services provided shall be resolved amicably within fourteen (14) days. If amicable resolution fails, the dispute shall be referred to the competent courts in the Kingdom of Saudi Arabia (Riyadh).
- The applicable law is the laws in force in the Kingdom of Saudi Arabia.
Article 12: Acknowledgment and Undertaking
- The Beneficiary acknowledges having read and understood all the terms and conditions in this Agreement and the Privacy Policy and accepts them.
- These Terms and the included policies constitute the entire agreement between the parties and supersede any prior agreements, if any.
- If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Acceptance of these Terms includes acceptance of the Privacy Policy and Cookies Policy.
